Changes to Exemption Code C41 Benefit Spouses and Common-Law Partners

The federal government recently announced changes to exemption code C41 that help spouses and common-law partners of authorized skilled foreign workers.

Spouses or common-law partners are now eligible to apply for open work permits if the principal foreign worker works part-time. The principal foreign worker must be able to financially support their family and themselves to qualify.

The principal foreign worker must still meet earlier exemption code C41 requirements such as employment in a NOC 0, NOC A, or NOC B occupation, physically residing in Canada while working, and holding a work permit valid for at least 6 months (or working under section R186).
